Organized in 1981 by John Neylon, Neylon & O’Brien’s practice covers the following areas:

Concentrating in civil litigation, the firm handles referred litigation matters. Referring practitioners are welcome to continue working on matters with Mr. Neylon and their clients.

Mr. Neylon has been practicing law in Massachusetts since 1973. His practice includes civil litigation in all State and Federal trial and appellate courts in the Commonwealth. He was educated at Boston College and its Law School and holds an L.L.M. Degree from Boston University. He is a licensed certified public accountant in Massachusetts and interacts effectively with other disciplines. See Teaching Resume and Research.

The firm uses traditional fee arrangements, results based fee agreements and other contingent fees where agreed upon and appropriate. Neylon & O’Brien, P.A. carries malpractice insurance in the amount of two million ($2,000,000) dollars.

Appellate Law

The firm is familiar with the technical requirements of both the Massachusetts and Federal Rules of Appellate Procedure. See Research.

Bankruptcy

The firm represents secured parties, unsecured creditors and debtors in bankruptcy. Attorney Neylon was a panel trustee in Boston during the 1980’s and has been successfully litigating adversary proceedings since that time.

Business Law

The firm organizes corporations, limited liability companies and other operational or asset holding entities, advises as to tax consequences and personal liability aspects of such entities, and assists owners in tending to the maintenance and governance of same.

Criminal

Attorney Neylon appears regularly in District Courts of the Commonwealth on a host of criminal matters, including motor vehicle violations, operating under the influence, including subsequent offenses and related matters. The firm also handles Registry of Motor Vehicle hearings and appeals and works with associated attorneys.

Domestic Relations/Divorce

The firm represents husbands and wives in divorce, modifications, contempts, arbitrations, mediations and interacts effectively with experts and social service providers.

Estate Planning

The firm coordinates with clients and other advisors, and oversees drafting and execution of appropriate instruments, including durable power of attorney, health care proxies, wills- simple, reciprocal, pourover and inter vivos trusts, including credit shelter trusts, and irrevocable insurance trusts. The firm works with outside counsel for Medicaid planning.

Forensic Accounting

John Neylon, J.D., C.P.A., LLM Taxation, works with other accountants and lawyers to enhance discovery, expert oral and graphic presentation of accounting, economic, mathematical, fraud related and damage matters.

Personal Injury

Numerous personal injury matters have been successfully resolved to the clients’ satisfaction. Attorney Neylon has been litigating matters for referring attorneys since the 1980’s.

Professional Liability

The firm defends attorneys, CPA’s, and other professionals in state and federal courts, in civil and criminal matters, and before the Board of Bar Overseers, the Board of Public Accountancy and other Boards of Registration.

Subrogation

The firm has handled routine and complex subrogated matters including those for fidelity bond insurers, workers compensation, general liability and property/casualty insurers.

Transactional Law

In September 2007, the firm represented as borrower’s counsel, a plant manager, who made a bootstrap acquisition of a division of a Fortune 50 company. Most of the firm’s business transactional work involves purchase/sale/ leaseback of family businesses, restaurants, etc.

White Collar Crime

Defense of white collar crime matters in both federal and state courts has been facilitated by working relationships with accountants, subrogating insurers and prominent members of the criminal defense bar.

Wills/Trust Probate

Routine estates are settled in all Massachusetts’ counties. Attorney Neylon has been hired to prosecute and defend several complex matters challenging and defending wills based upon fraud, duress and undue influence.

Worker’s Compensation

Attorney Neylon is often hired by other lawyers and insurers to bring so called “third party actions,” under M.G.L. c.152, sec. 15. The firm has working relationships with many practitioners who specialize in worker’s compensation.

Zoning/Licensing

The firm has represented applicants in front of zoning, planning, licensing boards, conservation commissions and state and federal agencies. The firm is often hired by municipalities to represent such boards in court when they are sued by unhappy applicants.
